Từ 01/02/2026, Bộ Tài chính chính thức áp dụng Thông tư 121/2025/TT-BTC, sửa đổi Thông tư
38/2015 & 39/2018 - tác động trực tiếp đến thủ tục hải quan, ... hồ sơ khai báo và quản lý thuế XNK.

Những thay đổi doanh nghiệp XNK cần đặc biệt lưu ý:
✔️ Cập nhật hệ thống phụ lục & mẫu hồ sơ hải quan → Ảnh hưởng trực tiếp đến cách khai báo tờ
khai, chứng từ thương mại, hồ sơ điện tử.
✔️ Siết chặt tính đồng bộ dữ liệu khai báo → Thông tin trên Invoice - Packing List - Hợp đồng - Tờ
khai phải nhất quán tuyệt đối.
✔️ Điều chỉnh thủ tục với các loại hình đặc thù → Hàng quá cảnh, gia công, sản xuất xuất khẩu,
chuyển cửa khẩu… không thể áp dụng cách làm cũ.

Áp dụng quy trình cũ sau 01/02/2026 có thể dẫn đến:
❌ Bị yêu cầu sửa tờ khai, bổ sung hồ sơ.
❌ Kéo dài thời gian thông quan, trễ kế hoạch giao hàng.
❌ Phát sinh chi phí lưu container, lưu bãi, dem/det.
❌ Nguy cơ bị kiểm tra sau thông quan hoặc xử phạt.

Khuyến nghị:
📌 Doanh nghiệp XNK cần rà soát lại quy trình khai báo, cập nhật mẫu biểu mới và phối hợp chặt
chẽ với đơn vị logistics/đại lý hải quan để tránh rủi ro.

⏰ Mốc thời gian bắt buộc: Áp dụng từ 01/02/2026 trên toàn hệ thống hải quan.

CIRCULARS 38 & 39 OFFICIALLY AMENDED - EFFECTIVE FROM 01 FEBRUARY 2026
From 01 February 2026, the Ministry of Finance will officially implement Circular No. 121/2025/TT-
BTC, amending Circular No. 38/2015/TT-BTC and Circular No. 39/2018/TT-BTC, with direct
impacts on customs procedures, customs declaration dossiers, and import - export tax
administration.
Key changes that import - export enterprises must pay close attention to:
✔️ Updated appendices and customs dossier templates → Directly affecting customs declaration
methods, commercial documents and electronic customs records.
✔️ Stricter requirements on data consistency in customs declarations → Information on Invoices,
Packing Lists, Contracts and Customs Declarations must be fully consistent and accurate.
✔️ Revised procedures for special customs regimes → Transit goods, processing trade, export
processing, and border - gate transfer shipments can no longer follow previous practices.
Failure to update procedures after 01 February 2026 may result in:
❌ Requests for declaration amendments or additional documentation.
❌ Extended customs clearance time and delayed delivery schedules.
❌ Additional costs for container detention, demurrage and storage.
❌ Increased risk of post - clearance audits or administrative penalties.
Recommendations:
📌 Import - export enterprises should review their current customs procedures, update the new
templates and appendices and closely coordinate with experienced logistics providers or licensed
customs brokers to minimize compliance risks.
⏰ Mandatory implementation date: 01 February 2026, applicable nationwide across the customs
system.
📣 The amendments to Circulars 38 & 39 represent not merely regulatory updates, but a
fundamental shift in how import - export operations are managed.
Early preparation ensures faster clearance, better cost control and on time delivery performance.

自2026年2月1日起, 越南财政部将正式实施第 121/2025/TT-BTC 号通函, 对第38/2015/TT-BTC 号通
函和第 39/2018/TT-BTC 号通函进行修订, 直接影响海关手续, 申报资料以及进出口税务管理.
进出口企业需重点关注的修订内容:
✔️ 更新海关附录及申报资料模板 → 直接影响报关申报方式, 商业单证及电子海关资料.
✔️ 加强申报数据 - 致性要求 → 发票 (Invoice), 装箱单 (Packing List), 合同及海关申报单之间的信息

✔️ 调整特殊贸易及通关模式的操作流程 → 过境货物, 加工贸易, 出口加工及转关货物不得继续沿用
旧操作方式.
2026年2月1日后仍沿用旧流程, 可能导致:
❌ 被要求更正申报或补充资料
❌ 通关时间延长, 影响交付进度
❌ 产生集装箱滞期费, 堆存费等额外成本
❌ 面临海关事后稽查或行政处罚风险

务商或报关代理密切配合, 以降低合规风险.
⏰ 强制实施时间: 自2026年2月1日起, 在全国海关系统统 - 适用
